Link Brokers  Application License Agreement

Important Notice
As part of the order process, you will be asked to
accept the terms of this Agreement.
This Agreement is a legal contract, which specifies the
terms of the license and warranty limitation between you
and Link Brokers , Inc. for each ColdFusion® open source Application.

Unless you have a different license agreement obtained
from Link Brokers , Inc., installation or use of the application
indicates your acceptance of the license and warranty
 limitation terms contained in this Agreement.
You should carefully read the following terms and
conditions before downloading or using the Custom Tag.

Limited License to Use and Distribute
You may install one copy of the application.  You may not copy
and/or redistribute the Application, it's source in whole or in
part.  Each server upon which the application is to run must
have installed a separately licensed copy of ColdFusion Application
Server software.

No Additional Licenses
This Agreement does not authorize you to use Link Brokers 's
names or trademarks or the fact that you are using the
application for any publicity or marketing or other
activities. 
You acknowledge and agree that all right, title and
interest in and to the application belongs to
Link Brokers , Inc.
You do not derive and will not be able to assert any title
or interest in the application other than the rights and
licenses granted under this Agreement. You may not decompile, 
disassemble or reverse engineer the application.

You acknowledge and agree that you do not receive any rights
to patents, copyrights, trademarks or any other rights or
licenses belonging to Link Brokers , Inc. beyond those expressly
granted in this Agreement.

Risk of Use
You understand that the application may have errors and may
produce unexpected results. You agree that any use of the
application will be entirely at your own risk.

No Warranty
THE Application IS PROVIDED "AS IS" AND WITHOUT WARRANTY,
EXPRESS OR IMPLIED. Link Brokers  SPECIFICALLY DISCLAIMS ANY
IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE.

Limitation on Liability
IN NO EVENT WILL Link Brokers , Inc. BE LIABLE FOR ANY DAMAGES,
 INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, LOST 
SAVINGS OR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES,
WHETHER RESULTING FROM IMPAIRED OR LOST DATA, SOFTWARE
OR COMPUTER FAILURE OR ANY OTHER CAUSE, EVEN IF
Link Brokers , Inc. IS ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES, OR FOR ANY OTHER CLAIM BY YOU OR FOR ANY THIRD
PARTY CLAIM.  SOME STATES DO NOT ALLOW THE EXCLUSION OF
IMPLIED WARRANTIES SO THIS LANGUAGE MAY NOT APPLY. 
IN SUCH CASE, Link Brokers 's LIABILITIES WILL BE LIMITED
BY THE ABOVE LIMITATION OF REMEDIES PROVISION.

U.S. Government Restricted Rights
If this license is acquired under a U.S. Government contract,
use, duplication or disclosure by the U.S.Government is subject
to restrictions as set forth in DFARS 252.227-7013(c)(1)(ii) for
Department of Defense contracts and as set forth in
FAR 52.227-19(a)-(d) for civilian agency contracts.
Link Brokers , Inc. reserves all unpublished rights under the United
States Copyright laws.

Miscellaneous
The internal laws of the State Of Florida controls this
Agreement if you are located in the United States or in
any country other than Canada; the laws of the Province
of Ontario shall control if you are located in Canada.  This

Agreement is the complete agreement between you and
Link Brokers , Inc. concerning the application.  The failure or
delay of Link Brokers , Inc. to exercise any of its rights under
this Agreement or upon any breach of this Agreement is not a
waiver of those rights or of the breach.

Because applications are open source there are no refunds, all sales are final!
